I am looking to buy my first house. As I was looking online, I found a house in a historic district part of town that I love and its for sale!! I have been inside this house and it really neat inside. But it has always been renting out to people. I called about this house a couple of days ago and found out some new people just signed a lease and moved in but they are in the Section 8 program.
I really don't think the new owners should have to honor the lease and was wondering if anything knew anything on this subject?? |

most leases stay in place from owner to owner, if you buy a house with a tenant they can stay until end of lease term.
you might find out though if they are on a month to month or just when the lease is up also depending on your state you might ask for a copy of the lease since you are wanting to buy so you can look it over and see if it has terminating provisions in it. then you can purchase and then give them notice |

if the house is being leased, but is also on the market for sale odds are there was something in the lease agreement about them having to vacate if a purchase agreement is accepted, so you are at no obligation to keep them in there, and im sure the leasee knows that if an offer is accepted they have to find somewhere else.so your in the clear....and remember offer at least $10,000 less then what there asking and have the seller cover closing costs.

It is going to be very hard to get a section 8 tenant out of the apartment.
You would have to go to court to get them out! Section 8 tenants are helped by the Housing Authority. The Housing Authority suggests them to not leave apartment until there transfer is approved by them, they find apartment after or they are evicted by a judge court order. Especially if they are paying their portion of the rent and Section 8 (the Housing Authority) agency is paying their portion of the rent, you are going to have to give them time to leave. **************************** Call the nearest housing authority( section 8) ******The transfer takes 6 months for it to be approved!! **You can give them 100 30 day notice, they will be told by section 8 that if they leave apartment they loose their section 8. That is why they don't leave until their transfer is approved! They have to apply for a transfer! |

thats not so bad
section 8 is good. tenants that the government pays rent for. what can you expect? you at least get paid rent.

after you purchase, you do not have to honor any documents...they were not between you and them. you are within your legal right to give them a 30 day notice...and in most states no reason has to be given --just the notice.
